Foodziyama Terms of Use
These terms are an agreement between you and Yauheni Zeliankou ("we", "us") for your use of the Foodziyama iPhone app and its online features (together, "Foodziyama"). By downloading or using Foodziyama you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the app.
Important: Foodziyama gives estimates, not medical advice. Calories and nutrients are approximate and can be wrong. If you have, or have had, an eating disorder, are pregnant or breastfeeding, have diabetes or another medical condition, or are under 18, talk to a doctor or registered dietitian before using calorie targets or weight goals.
1. Apple's terms also apply
Foodziyama is licensed to you, not sold, through Apple's App Store. These terms apply alongside Apple's Licensed Application End User License Agreement (the "Apple EULA"). If these terms conflict with the Apple EULA, these terms apply to the extent the Apple EULA allows.
You and we acknowledge that:
- these terms are between you and us, not Apple, and we, not Apple, are responsible for Foodziyama and its content;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple has no other warranty obligation for the app;
- we, not Apple, are responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or similar claims, and claims that the app infringes someone else's intellectual property;
- you confirm you are not located in a country subject to a U.S. government embargo or designated as "terrorist supporting", and are not on any U.S. government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
2. Who can use Foodziyama
You must be at least 13 years old, or at least 16 if you live in the European Economic Area or another country where a higher age applies. If you are under the age of majority where you live, you need a parent or guardian's permission, and they agree to these terms on your behalf.
3. What Foodziyama does
Foodziyama lets you photograph meals, cut out each dish, and keep a diary with estimated calories, protein, carbs and fat, plus weigh-ins and a daily plan. There is no account: your diary lives on your device and, if you choose, in your own iCloud.
Some features use our online service, which sends your photos and notes to an AI model to identify food and estimate nutrition (see the Privacy Policy). These features need an internet connection and may sometimes be unavailable.
4. Estimates, not medical advice
- Nutrition numbers are estimates. They are produced by an AI model and nutrition databases from a photo or description. Portion sizes, hidden ingredients, oils and recipes vary, and the AI can misidentify food entirely. Check and adjust values that matter to you.
- Your plan is a general guide. Daily calorie and macro targets are calculated with standard formulas from the age, sex, height, weight and goal you enter. They don't account for your medical history, medications or individual needs.
- Not medical advice. Foodziyama is not a medical device and does not diagnose, treat, cure or prevent any condition. Nothing in it is a substitute for advice from a doctor, dietitian or other qualified professional. Don't rely on it for decisions where accuracy matters for your health, such as insulin dosing or managing allergies.
- Eating disorders. Calorie counting and weight tracking can be harmful for people with, or at risk of, an eating disorder. If that applies to you, please don't use Foodziyama without guidance from a professional. If you are struggling, contact a local health service or helpline.
- Stop using the app and seek professional help if it causes you distress.
5. AI output
Dish names, ingredients and nutrition values produced by AI may be inaccurate, incomplete or unexpected. You are responsible for how you use them. AI results are provided "as is" and we don't guarantee any specific result. Please photograph only food: don't submit photos of people, documents or anything you don't have the right to share.
6. Subscriptions and purchases
Foodziyama is free to download with a daily limit on AI scans. Foodziyama Plus raises that limit and may be offered as a monthly or yearly subscription, or as a one-time lifetime purchase. Prices are shown in the app before you buy.
- Billing by Apple. All purchases are made through your Apple Account and processed by Apple under its terms. We don't receive your payment details.
- Auto-renewal. Subscriptions renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends. Your Apple Account is charged within 24 hours before renewal.
- Free trials. If a free trial is offered, it converts to a paid subscription automatically when it ends unless you cancel at least 24 hours before. If you buy a subscription during a trial, any unused part of the trial ends.
- Cancelling. Manage or cancel in the iOS Settings app under your Apple Account > Subscriptions. Cancelling stops future renewals; you keep Plus until the end of the period you've paid for. Deleting the app does not cancel a subscription.
- Refunds. Refunds are handled by Apple under its policies; request one at reportaproblem.apple.com. We can't issue refunds directly. This doesn't affect any rights you have under consumer law.
- Price changes. If a subscription price changes, Apple will notify you and, where required, ask for your consent before the new price applies.
- Restoring. Use "Restore purchases" in the app to restore Plus on a new device signed in to the same Apple Account.
- Lifetime purchase. "Lifetime" means for as long as we operate and support Foodziyama's online features, not for the lifetime of a person or device.
7. Scan limits and fair use
AI scans cost us real money for each photo, so both the free tier and Plus have daily limits. The current free limit is shown in the app. Plus is intended for one person logging their own meals; it includes a generous daily allowance, but it is not unlimited, and we may limit or pause AI features for usage far beyond what a person would reasonably need for personal food logging. Limits reset daily. We may change limits to keep the service sustainable; we'll show current limits in the app.
8. Acceptable use
You agree not to:
- access our servers or API other than through the official app, including with scripts, bots, scrapers or other automated tools;
- reverse engineer, decompile or extract the app's API, keys or prompts, except where the law expressly allows it;
- get around scan limits, rate limits, purchase checks or other protections, for example by faking or rotating device identifiers;
- resell, sublicense or offer Foodziyama or its AI features as part of another product or service;
- upload content that is illegal, that infringes others' rights, or that shows other people without their permission;
- try to make the AI produce harmful content, or interfere with or overload the service;
- use Foodziyama in violation of any law.
9. Your content
Your photos, notes and diary entries are yours. You give us a limited permission to process them only as needed to provide the features you use, as described in the Privacy Policy, including sending them to our AI and nutrition providers. We don't use your content for advertising, and we don't claim ownership of it.
Because your diary is stored on your device and in your own iCloud, you are responsible for keeping it backed up. We can't recover data that is deleted from your device or iCloud.
10. Our intellectual property
Foodziyama, including its software, design, text, graphics and name, is owned by us or our licensors and protected by law. Under these terms and the Apple EULA, we give you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, for your own non-commercial use. All other rights are reserved. Feedback you send us may be used to improve the app without any obligation to you.
11. Third-party services
Foodziyama relies on services from others, including Apple (App Store, iCloud, Maps), Anthropic (AI analysis) and the USDA FoodData Central database. We aren't responsible for those services, and their availability can affect the app. Place suggestions come from Apple Maps and may be inaccurate.
12. Changes and availability
We're always improving Foodziyama. We may add, change or remove features, and we may suspend or stop the online service, for example for maintenance, cost or legal reasons. If we stop offering the online service permanently, we will give reasonable notice in the app where possible. Your diary on your device stays usable for manual logging.
13. Termination
You can stop using Foodziyama at any time by deleting the app (and cancelling any subscription in iOS Settings). We may suspend or block access to the online features for a device that breaks these terms, abuses the service, or puts other users or the service at risk. Sections that by their nature should survive termination (such as 4, 5, 10, 14, 15 and 17) will survive.
14. Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOOD DIARY IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE APP OR ITS ESTIMATES WILL BE ACCURATE, UNINTERRUPTED OR ERROR-FREE.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE FOOD DIARY, OR FROM RELIANCE ON ANY ESTIMATE OR AI OUTPUT. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO FOOD DIARY IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR FOOD DIARY IN THE 12 MONTHS BEFORE THE CLAIM AND US $50.
Some places don't allow these exclusions or limits, so they may not apply to you. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud, and nothing affects your statutory rights as a consumer.
16. Indemnity
To the extent permitted by law, you agree to cover our reasonable costs from claims by others arising from your breach of these terms or misuse of Foodziyama. This does not apply to consumers where the law doesn't allow it.
17. Governing law and disputes
These terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules. Disputes will be handled by the courts of the Netherlands, unless the law where you live gives you the right to bring claims in your local courts. If you are a consumer in the EEA, UK or Switzerland, you keep the protection of the mandatory laws of your country of residence. Before filing a claim, please contact us so we can try to resolve the issue informally.
18. Changes to these terms
We may update these terms. The date at the top shows the latest version. If a change is material, we'll tell you in the app before it takes effect. Continuing to use Foodziyama after the change means you accept the new terms; if you don't, stop using the app and cancel any subscription.
19. General
If part of these terms is found unenforceable, the rest stays in effect. If we don't enforce a term right away, we don't waive it. You may not transfer your rights under these terms; we may transfer ours as part of a sale or reorganisation of the app. These terms, the Privacy Policy and the Apple EULA are the whole agreement between you and us about Foodziyama.
